Terms & Conditions
The terms that apply to this website and to removal services arranged with us.
1. About these terms
These terms apply to your use of the Darius Removals website and to quotes, bookings and removal or transport services arranged with us. In these terms, “we”, “us” and “our” means Darius Removals, and “you” means the person or business engaging our services.
Where we provide you with a separate written quote, booking confirmation or service agreement, that document applies in addition to these terms. If there is a conflict, the specific written document takes priority.
2. Using this website
This website is provided for general information about our services. You agree not to use it in a way that is unlawful, that interferes with its operation, or that attempts to gain unauthorised access to any part of it or the systems behind it.
We aim to keep the information on this site accurate and current, but it is general in nature. Nothing on this website is an offer capable of acceptance — a booking only exists once we have confirmed it with you directly.
3. Quotes and estimates
Quotes are based on the information you give us — the pickup and delivery locations, the volume and nature of what is being moved, access at both ends and your preferred timing.
If the actual job differs materially from what was described — significantly more items, restricted access that was not mentioned, long carrying distances, or items requiring special handling — the price may need to be adjusted. Where that happens, we will raise it with you before continuing wherever it is practical to do so.
Unless stated otherwise in writing, a quote is an estimate rather than a fixed price, and remains valid for the period noted on the quote.
4. Bookings and scheduling
A booking is confirmed once we have agreed the date and details with you. Arrival times are given as a window rather than an exact time, because traffic, weather, access and the preceding job all affect the schedule.
Local removal services generally operate Monday – Friday, 8:00 AM – 8:00 PM. Interstate services operate on scheduled runs, and weekend interstate transport operates around the clock subject to scheduling, booking volume and availability. Availability for any particular date is confirmed at the time of booking.
5. Your responsibilities
You agree to:
- give accurate and complete information about what is being moved and the access at both addresses;
- be present at the pickup and delivery addresses, or nominate someone who can act on your behalf;
- arrange any building, lift or loading dock bookings and parking permits required at either address;
- pack and seal boxes securely, unless you have engaged us to pack them;
- empty drawers, cabinets, fridges and appliances, and disconnect appliances before we arrive;
- identify any fragile, valuable or unusually heavy items in advance;
- keep documents, jewellery, cash, medication and other valuables with you rather than in the load;
- ensure the premises and access routes are safe for our team to work in.
6. Items we do not transport
Unless we have specifically agreed otherwise in writing, we do not carry:
- flammable, explosive, corrosive or otherwise dangerous goods, including gas bottles, fuel and solvents;
- illegal items or substances;
- live animals or plants;
- perishable food or goods requiring refrigeration or temperature control;
- cash, jewellery, precious metals, securities or similar high-value portable items;
- items you do not legally own or have authority to move.
We also do not provide warehousing or long-term storage, refrigerated transport, or dangerous goods transport. If your requirements include any of these, please tell us before booking so we can be upfront about whether we can help.
7. Access, delays and conditions
Where access at either address is more restricted than described — no lift available, no parking within a reasonable distance, stairs that were not mentioned, or a locked or unattended property — additional time and cost may apply.
We are not responsible for delays caused by circumstances outside our reasonable control, including traffic, road closures, weather, building management restrictions, or delays caused by third parties such as agents, landlords or settlement processes.
8. Payment
Payment terms, accepted payment methods, any deposit required and when payment is due are set out in your quote or booking confirmation. Unless agreed otherwise in writing, payment is due on completion of the job.
Where a deposit has been paid, it is applied to the final amount payable.
9. Changes and cancellations
If you need to change or cancel a booking, tell us as early as you can and we will do what we reasonably can to accommodate it. Cancellation or rescheduling fees may apply where a booking is changed at short notice, and any such fees will be set out in your quote or booking confirmation.
We may need to reschedule a booking in exceptional circumstances such as vehicle breakdown, illness or unsafe conditions. If that happens we will contact you as soon as possible and offer the earliest practical alternative.
10. Liability
We take care with your belongings and handle them professionally. To the extent permitted by law, and subject to section 11 below, our liability in connection with a job is limited to the direct loss or damage caused by our negligence, and we are not liable for indirect or consequential loss such as lost income, business interruption or missed settlement costs.
We are not responsible for damage arising from:
- items packed by you where the damage results from inadequate packing;
- pre-existing damage, wear, or defects in an item;
- items that are inherently fragile or unsuitable for transport and were not identified to us;
- mechanical or electrical failure of appliances or equipment where there is no external damage;
- damage to a property caused by moving an item along a route you directed us to use where we advised against it.
Insurance: insurance arrangements are not covered by these terms. If you would like to know what cover applies to your move, or you would like to arrange your own transit cover, please ask us before your booking is confirmed so the position is clear in writing.
Any claim should be raised with us in writing as soon as possible after delivery, with details and photographs where relevant, so it can be looked into promptly.
11. Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where our services come with guarantees that cannot be excluded, and we fail to meet them, you are entitled to the remedies the law provides.
12. Website content and intellectual property
The content of this website, including text, layout, graphics and the Darius Removals name and logo, is owned by us or used with permission. You may view and print pages for your own use in considering our services, but you may not reproduce, republish or use the content commercially without our written permission.
The imagery used on this website is computer generated and is illustrative only. It does not depict actual jobs, vehicles, premises or personnel of Darius Removals, and no person shown is a real individual.
13. Governing law
These terms are governed by the laws of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria and the courts able to hear appeals from them.
If any part of these terms is found to be unenforceable, the remaining provisions continue to apply.
